A division bench of the Supreme Court sets aside orders of the Kerala High Court, First Appellate Court, and Trial Court, holding that Order XIV Rule 2(2) CPC permits prospective ordering of trial on preliminary issues of law, but cannot be invoked retrospectively to sever an issue after parties have embarked upon a common trial.
